On November 20, 2025, a federal judge in New York vacated a Trump administration policy that had paused visa processing for nationals of 75 countries.
The suspended list included Afghanistan, Iran, Russia, Somalia, and dozens of other countries the administration flagged as likely to produce 'public charge' recipients.
The 'public charge' rule dates to the Immigration Act of 1882 and bars admission of noncitizens 'likely to become a public charge.'
Most legal immigrants are already barred from most federal means-tested benefits for their first five years in the U.S. under 1996 welfare reform (PRWORA).
The Trump administration argued the pause was needed to review vetting; the judge ruled it exceeded statutory authority.
