The 60-day grace period was created by a Department of Homeland Security rule finalized in January 2017 under the Obama administration.
USCIS caps new H-1B visas at 85,000 per year, including 20,000 reserved for holders of U.S. master's degrees or higher.
In FY 2023, roughly 386,000 H-1B petitions were approved, with about 72% going to workers born in India, according to USCIS data.
The Trump administration in September 2025 also imposed a $100,000 fee on new H-1B petitions, its most aggressive move yet against the program.
